2004-11-22 Berger (PSE, AT) Supports Polish Position asks Council to Revise Political Agreement

Maria Berger, head of the delegation of the austrian socialist members of the European Parliament, issues a press release in support of the Polish move to oppose the European Council's Software Patent Agreement of 2004-05-18 and announces that, should the Council fail to do so and persist in ignoring the Parliament's amendments, her group would push for reinstatement of the 1st reading's amendments in 2nd reading.
She also said that Europe needs some period of thinking the about this directive.
Such period is only possible (without rejecting the directive and having to restart the whole co-decision procedure) if no common position is adopted for now. Otherwise, the parliament would have to act within three months and would certainly change the directive again, because even the MEPs which say that this directive is badly needed say, that the Council text needs changing, for example Joachim Wuermeling:
He said that programs which compress data would be patentable under the council text which needs to be prevented.

Maria Berger, Delegationsleiterin der SPÖ-Europaabgeordneten, begrüßt die Ankündigung der polnischen Regierung, die EU-Richtlinie zur Patentierbarkeit von Software im Ministerrat nicht zu unterstützen. 'Nun ist auch die österreichische Bundesregierung aufgefordert, den Richtlinienentwurf abzulehnen. Europa braucht in dieser wichtigen Frage eine Nachdenkpause', erklärt Berger heute gegenüber dem SPÖ-Pressedienst.
Sollte von den Regierungen dennoch ein gemeinsamer Standpunkt verabschiedet werden, liege der Ball wieder beim EU-Parlament, betont Berger als SPE-Koordinatorin des zuständigen Rechtsausschusses. 'Dann gilt es wieder jene Entschärfungen der Richtlinie durchzusetzen, die in erster Lesung beschlossen und vom Rat ignoriert wurden', so die Europaabgeordnete abschließend.
